BPRATV Return, Refund, and Warranty Policy

Returns

• Returns are accepted within 30 days of purchase, unless otherwise noted. For EU customers exercising their statutory right of withdrawal, see the EU Customer Rights section below.

• All returned parts must be:

  • 100% complete, unused, and brand new

  • In the original packaging whenever possible

  • Not installed, mounted, assembled, modified, run, or prepped for installation

  • Free of oil, fuel, gas, coolant, grease, dirt, sealant, gasket material, metal shavings, or any other fluids, residue, or contaminants

• Opened packaging alone does not automatically disqualify a return; however, the part must still be unused, uninstalled, complete, clean, and in returnable condition.

• We cannot accept engine, ATV, motorcycle, UTV, or powertrain parts that have been installed, mounted, run, modified, assembled, prepped for installation, or exposed to oil, fuel, gas, coolant, grease, dirt, sealant, gasket material, metal shavings, or other fluids or contaminants. Once a part has been used, installed, contaminated, or exposed to engine fluids, it cannot be resold as new and will be refused upon receipt or subject to a reduced refund where permitted by law. Shipping used, oil- or fuel-contaminated parts is not only harmful to the environment but is also highly illegal. The transportation of hazardous materials — including parts contaminated with petroleum products, fuels, or engine fluids — is regulated under federal law (49 C.F.R. Parts 100–185), and violations may result in significant fines and penalties. By submitting a return, the customer certifies that all parts are clean, free of fluids, and safe for shipment. BPRATV LLC reserves the right to refuse, return, or dispose of any shipment received in violation of these requirements, and any costs incurred as a result will be the sole responsibility of the customer.

• If a returned item is refused after inspection, BPRATV LLC will notify the customer. The customer is responsible for arranging and paying for return shipping of the refused item unless otherwise required by applicable law. We may hold the item for up to 30 days after notification. If return shipping arrangements are not made within that period, the item may be treated as abandoned where permitted by law.

• Customers are responsible for return shipping for standard returns, change-of-mind returns, and EU withdrawal returns, unless the return is due to our error, such as receiving the wrong item, a damaged item, or a defective product.

• If the return is due to our error, a damaged item, a defective product, or a non-conforming product, BPRATV LLC will cover the appropriate return shipping costs as required by applicable law and work to resolve the issue promptly and properly.

• A 15% restocking fee applies to all non-defective standard returns, except where prohibited by law. This restocking fee does not apply to EU customers exercising their statutory 14-day right of withdrawal. However, deductions may apply for diminished value caused by handling beyond what is necessary to inspect the item, including installation, use, damage, modification, missing parts, missing packaging, or contamination.

Refunds

• Refunds are issued only for qualifying parts returned under the conditions above. Items showing signs of installation, fluid contact, wear, damage, modification, contamination, or use are not eligible for a standard return refund. Refunds are processed once the item is inspected and approved by BPRATV LLC.

• Refunds are issued to the original payment method unless otherwise agreed or required by law.

• Shipping charges, expedited shipping, premium shipping upgrades, and other non-standard delivery charges are not refundable unless required by law.

EU Customer Rights (European Union)

If you are a consumer located in the European Union or European Economic Area, the following rights apply in addition to our standard policy. If there is a conflict between this policy and mandatory EU or local consumer law, mandatory consumer law will apply.

• Right of Withdrawal — 14 Days: For eligible online purchases, EU consumers have the right to withdraw from the purchase within 14 calendar days from the day the customer, or a designated third party, receives physical possession of the last item in the order, without giving a reason. If the deadline falls on a non-working day, it may be extended to the next working day where required by law.

• How to Exercise the Right of Withdrawal: To exercise the right of withdrawal, the customer must notify BPRATV LLC within the 14-day withdrawal period by contacting us at sales@bpratv.com with the order number and a clear statement that they wish to cancel and return the item.

• Return Shipping for Withdrawal: For standard EU withdrawal or change-of-mind returns, the customer is responsible for the cost of returning the goods to BPRATV LLC. BPRATV LLC does not provide prepaid return shipping for standard EU withdrawal returns unless we choose to do so or unless required by law.

• No Restocking Fee for EU Withdrawal: No restocking fee will be charged for a qualifying EU statutory withdrawal return. However, the customer may be responsible for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the item.

• Refund Timeline for EU Withdrawal: For qualifying EU withdrawal returns, BPRATV LLC will refund the purchase price and the original standard delivery cost, if applicable. Any premium shipping upgrade, expedited shipping, or other delivery option above standard delivery is not refundable unless required by law. We may withhold the refund until we receive the returned goods or until the customer provides proof that the goods have been returned, whichever occurs first. Refunds will be issued no later than 14 days after the returned goods or proof of return shipment are received, unless a different timeline is required by applicable law.

• Condition of Goods & Diminished Value: Under EU law, you are permitted to examine the parts only to the extent necessary to establish their nature and characteristics — similar to inspecting a part in a physical retail store. The right of withdrawal does not permit installation or use. If an item has been handled beyond this scope — specifically if it has been opened, mounted, prepped, or contaminated with oil, fuel, gas, coolant, grease, dirt, sealant, gasket material, metal shavings, or other fluids or contaminants — its economic value is entirely diminished. In such cases, we reserve the legal right to reduce your refund by up to 100% to reflect the unsellable condition of the part.

• Items That May Not Qualify for Withdrawal Returns: Certain items may be excluded from the right of withdrawal where permitted by law, including custom-made or personalized products, special-order products made or sourced specifically to the customer's specifications, and items that cannot be returned in resaleable condition due to installation, use, damage, modification, contamination, or safety and compliance concerns.

• Defective, Damaged, Incorrect, or Non-Conforming Goods: If an item arrives damaged, incorrect, defective, or not as described, the customer must contact BPRATV LLC as soon as reasonably possible with the order number, photos if available, and a description of the issue. Where required by applicable EU consumer law, consumers may be entitled to repair, replacement, price reduction, refund, or other remedies for goods that are defective or do not conform to the contract.

• EU Legal Guarantee: EU consumers may be entitled to a minimum 2-year legal guarantee for goods that are faulty or do not conform to the contract at the time of delivery. This statutory right is separate from, and not limited by, any manufacturer warranty or voluntary commercial warranty offered by BPRATV LLC or the manufacturer. This statutory warranty does not cover failures caused by improper installation, tuning errors, or fluid contamination after delivery.

• Dispute Resolution: If you are an EU consumer and we cannot resolve a complaint directly, you may contact your local consumer protection authority, national alternative dispute resolution body, or European Consumer Centre for assistance. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

General Warranty

• All new products include a 1-year limited manufacturer warranty against defects in materials or workmanship, unless otherwise noted. Used products are sold as-is and generally do not carry a warranty unless specifically stated.*

• Any manufacturer warranty or voluntary warranty is offered in addition to, and does not replace or limit, any mandatory consumer rights that may apply under applicable law.

• Due to the nature of high-performance and racing applications, BPRATV LLC components are sold without any additional express warranty or implied warranty of merchantability or fitness for a specific purpose to the fullest extent permitted by applicable law.

• BPRATV LLC shall not be liable for incidental, indirect, or consequential damages, including but not limited to: property damage, equipment damage, lost profits, loss of use, or replacement costs, except where such limitation is not permitted by applicable law.

• Installation of high-performance parts may void the vehicle manufacturer's warranty and/or render the vehicle illegal for street use in some jurisdictions.

Special Warranty Notes

Cylinder Warranty

• All CP Industries Yamaha Banshee CUB Cylinders purchased from BPRATV include a Lifetime Warranty.*

• If a cylinder fails for reasons not related to improper installation, tuning, break-in, maintenance, misuse, or abuse, we will repair or replace it free of charge.

• The cylinder must be returned with proof of purchase for inspection by BPRATV and Millennium Technologies (no exceptions).

• Warranty covers the cylinder only — no labor, other parts, or compensation.

• Warranty is valid only for the original purchaser and cannot be converted to a refund or discount, except where otherwise required by applicable law.

Titanium Fastener Warranty

• If a titanium fastener purchased from us fails during use, it will be replaced with a new one.

• Warranty does not cover failures caused by improper installation, incorrect torque, misuse, modification, or abuse.

• Fasteners must be returned for inspection before replacement.

• Warranty decisions are not made based only on photos, emails, phone calls, or third-party assessments.

Warranty Conditions

• This product is NOT DIY. Engine building and tuning require professional skills. We strongly recommend installation by a qualified, experienced mechanic.

• Warranty claims require the part(s) to be physically returned for inspection, unless otherwise required by applicable law.

• Warranty does not cover failures caused by:

  • Improper installation or tuning

  • Incorrect break-in procedures

  • Lack of maintenance

  • Misuse or abuse

  • Racing, competition, or high-performance use beyond the intended application

  • Modification, alteration, or use with incompatible parts

  • Oil starvation, fuel contamination, improper fuel mixture, overheating, detonation, lean running, or other operating conditions outside proper mechanical use

• If a warranty claim is denied, the customer is responsible for the cost of return shipping, unless otherwise required by applicable law. We may hold the item(s) for up to 30 days after notification of denial. If shipping arrangements are not made within this period, the item(s) may be treated as abandoned where permitted by law.

Legal and Compliance Notice

• Products are exempt from the emission standards and related requirements of 40 C.F.R. § 1051 as provided by 40 C.F.R. § 1051.620, and California Vehicle Codes §§ 27156 and 38391.

• Products are sold only for use with EPA-certified, purpose-built, nonroad vehicles used solely for closed-course competition/racing. This product is not intended for recreational use or for use on public highways or rights of way.

• By purchasing, the buyer represents and warrants that the product will only be used with vehicles that are exempt from federal and state noise and emission regulations under applicable law.

• Nothing in this policy is intended to exclude, restrict, or limit any mandatory consumer rights that cannot be excluded under applicable EU or local law.
